End User License Agreement (EULA) 1. Introduction This End User License Agreement ("Agreement") explains the rules and regulations for the use of the "Callio - Smart Phone & Contacts" mobile application (hereinafter referred to as the "App") developed by Mobisoft Software. By accessing and using our App, you agree to these terms. If you do not accept these terms, you should not use our App. For detailed information on how your data is handled locally and how analytics are processed, please review our Privacy Policy: https://callioapp.com/sozlesmeler/calloPrivacy.txt 2. Acceptance of Terms By using our products, you agree to these Terms and Conditions. Mobisoft Software reserves the right to modify these terms. Users will be notified of significant changes via in-app notifications. Your continued use of the App after such changes constitutes your acceptance of the modified terms. 3. Scope of License Mobisoft Software grants you a non-transferable license to use the App on any device that you own or control. This license is limited by the usage rules set forth in the Apple App Store and Google Play Terms of Service. Copying, reverse engineering, extracting source code, or modifying the App is strictly prohibited. 4. Legality of Use By using the App, you warrant that: You will use the App for legal purposes only; You assume all responsibility for your use of the App and hereby indemnify Mobisoft Software from any damages occurring during such use. 5. Call & Contact Data Privacy (Local Storage Policy) 5.1 Local Data Storage (Offline-First) The App operates on a "Local-First" basis to ensure maximum privacy: Contacts & Call History: Your contact list, phone numbers, and call history are processed and stored exclusively on your device's local memory. No Server Upload: We do not upload, sync, backup, or transfer your personal contact details or call history to our servers or any cloud storage. Data Control: Since your personal data never leaves your device, you have full control over it. Uninstalling the App will permanently delete all local data associated with the App. 5.2 Analytics and Usage Data While personal data stays on your device, we collect anonymous technical data to ensure the App functions correctly. This includes: App stability and crash reports. Usage statistics (e.g., which screens are visited, session duration). Device type and operating system version. Note: This data cannot be used to identify you personally or access your contact list. 5.3 International Data Transfers Personal Data: Since your contacts and call history are stored locally, they are never transferred internationally by us. Analytics Data: Anonymous usage data may be processed by our third-party analytics providers (e.g., Google Firebase) on servers located worldwide (including the US and EU) to generate aggregate usage statistics. 5.4 Third-Party Services The App uses the following services to function: Flutter Contacts: Used to access your contacts locally on the device. url_launcher: Used to initiate phone calls. Hive: Used for local data storage on your device. Google Firebase/Analytics: Used solely for anonymous crash reporting and usage analysis. 6. User Obligations and Rights 6.1 Data Responsibility Data Loss: Because we do not store your data on our servers, we cannot restore your data if you lose your device, uninstall the App, or clear the App's storage. You are responsible for backing up your own device. Security: Since data resides on your device, the security of your data depends on the security of your phone (e.g., use a screen lock). 6.2 Your Data Rights (GDPR & KVKK) Since we do not process your personal data on our servers: Right to Access/Correct: You can access and correct your data directly within the App interface. Right to Erase (Right to be Forgotten): You can permanently delete all your data by uninstalling the App or using the "Clear Data" option in your device settings. No request to us is required as we do not hold your data. 7. Copyrights and Trademarks All content found in the App (design, interface, code, brand) is the intellectual property of Mobisoft Software and is protected by copyright laws. 8. Disclaimer of Warranty The App is provided "AS IS" without any warranty. We do not guarantee that the App will be error-free or uninterrupted. We disclaim all implied warranties of merchantability or fitness for a particular purpose. 9. Limitation of Liability To the maximum extent permitted by law, Mobisoft Software shall not be liable for any indirect, incidental, or consequential damages (including loss of data) arising from your use of the App. Since data is stored locally, we are not liable for data loss caused by device failure or user action. 10. Service Improvement (Analytics) Mobisoft Software collects technical, non-personal data to improve the App. Purpose: To fix bugs, prevent crashes, and understand which features are popular. Opt-Out: You may likely opt out of analytics collection via the App settings (if this feature is supported in your version). Data Retention: Anonymous analytics data is retained by our analytics providers (e.g., Google) in accordance with their policies, usually for a limited period to generate trends. 11. External Services The App may use external services (e.g., Google Maps, Apple Maps) for specific features. Your use of these features is subject to the terms of those third-party service providers. 12. Termination You may terminate this agreement at any time by uninstalling the App. Upon uninstallation, all your locally stored data within the App will be deleted by your operating system. 13. Governing Law These Terms are governed by the laws of the Republic of Turkey. Any disputes shall be subject to the exclusive jurisdiction of the Samsun Courts. 14. Amendments We may update these terms to reflect changes in our service or legal requirements. Material changes will be notified via the App. 15.
